The use of cannabis and CBD oil products is on the rise after their medicinal and recreational use was legalized in over half the country. Unfortunately, while you may now be able to use CBD oil in the comfort of your own home, these new laws don't intervene with your employer's right to forbid employees to use CBD oil, which means you may still be required to do drug testing periodically as an employee.

Whether or not you pass your next CBD drug test could result in a number of negative consequences you would likely prefer to avoid. Drug testing at work at work is serious business with many potential negative ramifications.  Fear not, we're here to provide all of the information you need for your next drug testing.

What is a Drug Test for Cannabis Testing For

If you are reading this article, you are likely a CBD oil users or are interested in using CBD products but are concerned about CBD drug test results from the use of CBD.

A cannabis test is not a CBD drug test, it is testing for THC or THC metabolites which is a cannabis compound from cannabis plants, both marijuana and hemp.  So again, CBD is not the concern, what is the concern is the amount of THC in the CBD you are consuming.  So if you are going for  urine drug testing, it is not a CBD drug test.

What is THC

THC is short for tetrahydrocannabinol, which is the psychoactive ingredient present in marijuana in high levels, and also present in Hemp plants, however in significantly lower levels.  THC is known to create the psychoactive effects many know as a “high.”

However, CBD is most commonly produced from the Hemp plant which does contain small amounts of THC however per the Farm Bill Act of 2018, manufacturers are required to reduce the amount in Hemp to below 0.3 THC% for it to be legally sold as CBD oil.

So should you stress out about testing positive on a CBD test because you are taking CBD that contains small amounts of THC? That depends on how much you consumed, what type of CBD oil you consumed, how long ago you took it, and what type of testing will be performed.

Common Types of CBD oil

Broad Spectrum CBD oil

Broad Spectrum CBD oil is a product that has all or most of the beneficial compounds of the Hemp plant but the THC is intentionally removed.  This is the preferred CBD product for many users as they reap all the benefits of the cannabis sativa plant without any of the negative psychoactive effects or the likely hood of a positive drug test result.  Palm Organix™ entire line of CBD product is THC Free (0.0%).  If you are concerned about drug screenings, Broad Spectrum CBD oil is the one you should choose.  This is a pure CBD oil some users prefer

Full Spectrum CBD oil

Full Spectrum CBD oil is defined as using all of the cannabinoids of the Cannabis Sativa plant including THC.  Even though it may be a small amount of THC, these CBD products contain some THC. Again for it to be legal, the pure CBD product must contain less than 0.3% THC levels.  Although 0.3% THC is only low levels trace amount, regular use of Full Spectrum CBD oil products could result in a positive drug test screening for THC.  If you are consuming a lot of Full Spectrum CBD oil, the result for some will likely be tested positive for drug screenings (you will fail).

How Long Will it Take Until THC is Out of Your System

Many people are concerned about taking CBD oil as they are fearful of failing a test.  Generally speaking, when you are asked to take a cannabis use drug test, the result is screening for THC, not CBD oil or CBN, the other popular compound content.

Let’s start by explaining the cannabis plant which has two strains, Marijuana and Industrial Hemp. Both strains contain THC however, Marijuana plants have high levels of THC compound whereas Hemp plants are low in THC.

First, it's important to be aware of any products you're using that might have trace amounts of THC in the hemp CBD oils.

It's also important to know that different types of tests have different windows of time for detecting THC or cannabis usage.

Your standard urine test can typically detect trace amounts of THC in CBD oil five to 13 days after usage. Blood tests, a more short term form of testing, can detect usage in a window of five hours - seven days.

If you're a daily user of hemp derived CBD oil that contains THC, it will generally show in saliva tests for roughly 72 hours. While the hair follicle test can detect THC usage within the last 90 days.

If you are a regular consumer of marijuana, THC will likely be in your system for much longer.  The THC content from Marijuana use will be significantly higher as marijuana products contain up to 30% THC in the cannabis compounds and you will test positive. This is the same for medical marijuana drug use as the amount of THC will also produce a positive test.

Can I Legally Refuse a Drug Test?

There are plenty of grey areas when it comes to the legalities of drug screening. For one, it will heavily depend on the state laws in which you live.  Drug testing varies from state to state laws.

It will also depend on how much notice you received before being asked to take a drug screening. For example, if you were informed that monthly urine drug testing was a part of your job description prior to taking the job, then you could potentially be fired for refusing one.

However, many state laws protect you from having to take a test that was "sprung" on you without any notice and for no reason.

This will also depend on the reason why you are being tested. For example, a hemp derived CBD test may be part of your probation requirements or part of a court mandated custody agreement.  These types of drug screening tests may be unavoidable.

If you believe you're within your rights to refuse drug screening tests and the privacy of your health information, it's best to first speak with an attorney and be entirely aware of what the legal implications of your refusal may be.

The Different Types of Drug Tests

While every TV show or movie involving a drug test typically shows someone urinating into a cup, this isn't always the way they are administered.

There are a variety of tests which vary in timing and accuracy. The different types of drug tests include:

  • Urine
  • Saliva
  • Blood
  • Hair test
  • Perspiration

While urine tests tend to be the most common (as they are the most affordable), it does not mean you won't run into other methods.  Also, you should be aware of a false positive.  Just because your urine drug test showed you failed, it could be a false positive.  A false positive means you tested for THC or the compound screened for but it was inaccurate.

Avoiding a Positive Drug Test

The first and most obvious way to pass your next test is to buy a CBD oil Brand that does NOT contain THC and has supporting third-party lab testing.  As discussed above, this type of CBD oil is known as “Broad Spectrum” CBD.

It goes without saying if you do not want to produce a positive result for THC, refrain from marijuana use as this will result in a positive test result.

Use a Broad Spectrum CBD oil

Broad Spectrum means that the CBD products have all the beneficial cannabinoids and terpenes from the Hemp plant BUT all the THC is intentionally removed.  Many CBD products users feel that Broad Spectrum CBD oil is the best CBD option available in the marketplace as you receive all the benefits of the cannabis plant without any of the negative psychoactive side effects and the possibility of failing a test. It is important that the third party lab test support the product is THC-Free.

However, if the CBD products you are consuming has 0.3% THC, and is a normal part of your daily life and consumed regularly, there are other alternatives you may consider to avoid failing a cannabis drug screening test.

Folklore on how to pass a Drug Test

Hopefully you read this article before you started using hemp derived CBD products.  If you did not and you are facing a CBD product screening and you are concerned about a positive result from small amount of THC consumed, below are some strategies people have tried.  Palm Organix™ does not endorse this content and is not providing any medical advice, all rights reserved.

Again, these suggestions will depend on the type of test that will be administered.

For example, there are a number of shampoos specifically designed to remove traces of THC and pass a hair follicle drug test. Keep in mind—samples can be taken from anywhere in the body.

Many swear by "washing themselves out" for urine screenings. This means dramatically increasing the number of fluids you take in and urinating often to rid yourself of any trace amounts.

Blood tests are easier to pass on their own due to a short detection window.

If you know exactly when your drug test is scheduled, you can also abstain from CBD oil with THC for a period of time while simultaneously using a detox drink product designed specifically for passing some exams.

Talk to Your Employer Before you Fail a Drug Test

If the test is based on your job, it may be best to talk to your employer. While we don't suggest admitting that you use CBD oils that contains THC, it might be beneficial to discuss why they object to the use of CBD oil.

Perhaps educate your employer on the many benefits of CBD oil and that studies have even found it can aid in focus and attention spans.

When in doubt, see if your employer would be comfortable with foregoing the urine drug tests in the event that you can get a doctors prescription for medicinal use of CBD oils.
